1. Introduction
Destination Concierge (“we,” “our,” or “us”) is a Destination Management Company (DMC) based in Germany, specializing in providing incoming travel services to travel advisors based in the United States. Our services are intended for resale by travel advisors to their clients. Destination Concierge does not offer flight bookings. By using our services, you agree to comply with these Terms and Conditions.
2. Scope of Services
Destination Concierge provides tailor-made travel arrangements, including but not limited to:
– Accommodation bookings
– Ground transportation
– Tour planning and excursions
– Dining and event reservations
– Wine Walks
– Other concierge services upon request
All services are subject to availability and may be modified without prior notice.
3. Booking and Payment
3.1. Booking Requests
– All booking requests must be submitted in writing via email or through an authorized platform.
– Requests should be made with sufficient lead time to ensure availability.
3.2. Confirmation and Deposit
– Bookings are confirmed upon receipt of a non-refundable deposit as specified in the booking agreement.
– Some services may require full prepayment at the time of booking.
3.3. Payment Plan
– We offer up to three installments, incl. the receipt of a 10% non-refundable deposit, leading to the final payment two months in advance of the travel date.
3.4. Final Payment
– Final payment is due as per the payment schedule agreed upon in the booking confirmation. Latest two months in advance. If the booking is less than two months away from the travel date, payment in full is due at the time of booking.
– Failure to pay on time may result in cancellation without refund.
3.5. Payment Methods
– Payments must be made via bank transfer, credit card or other agreed-upon payment methods.
– All banking fees are the responsibility of the payer or other agreed-upon payment availabilities.
4. Cancellation and Refund Policy
4.1. Cancellation by the Travel Advisor
– Cancellations must be made in writing.
– Cancellation fees depend on the service provider’s policy and will be communicated upon booking.
– General cancellation fees:
- 60 days in advance – 25% of the agreed-upon amount in the booking
- 59 to 30 days in advance – 50%
- 29 to 15 days in advance – 75%
- after that – 90%
– Deposits are non-refundable unless stated otherwise.
– Non-refundable hotel bookings are non-refundable unless stated otherwise.
4.2. Cancellation by Destination Concierge
– We reserve the right to cancel a booking due to unforeseen circumstances (e.g., force majeure, supplier unavailability). In such cases, a full refund will be provided.
5. Changes and Modifications
– Requests for changes must be submitted in writing and are subject to availability and possible additional charges.
– Destination Concierge reserves the right to modify itineraries due to operational or safety concerns.
6. Responsibilities and Liability
6.1. Role of Destination Concierge
– We act as an intermediary between travel advisors and third-party service providers. We are not liable for any issues arising from third-party services, including delays, cancellations, or service quality.
6.2. Limitation of Liability
– Destination Concierge shall not be held liable for losses, damages, or injuries resulting from services provided by third parties.
– Our liability is limited to the value of the booked services.
7. Travel Documents and Requirements
– The travel advisor and their clients are responsible for ensuring all necessary travel documents, visas, and health requirements are met.
– Destination Concierge does not provide visa assistance or insurance.
8. Confidentiality and Data Protection
– We handle all client information in accordance with applicable data protection laws.
– Personal information will not be shared with third parties except as required to fulfill booking requests.
9. Governing Law and Jurisdiction
– These Terms and Conditions are governed by the laws of Germany.
– Any disputes shall be subject to the exclusive jurisdiction of German courts.
